Missing Persons

One of the most common challenges that process servers face is trying to serve someone who has seemed to have disappeared. Whether the disappearing act was intentional or not, it makes for extra work for the process server. They can overcome this challenge with skip tracing and other resources for finding missing individuals.

No Trespassing

Process servers are not law enforcement; therefore, they have to follow the same laws as everyone else. This means that when a no trespassing sign is posted, they cannot go onto the property uninvited. This is a common way for people to try to avoid service of process. This can be overcome by serving the individual at another location, such as at work.

Mistaken Identity

Some people try to avoid service of process by claiming to be someone else, and therefore not the person that the papers are intended for. Good process servers will ask for a recent picture or pull one from social media, so that they know when they have reached the correct person. The process server can leave the papers in the door if the person is identified and still refuses to take them.
